Victory before the Court of Appeal in Wrocław

On November 18, 2010 the Court of Appeal in Wroclaw seated the case of appeal of our Client (NK.pl) represented by our Law Firm. The appeal was lodged against the sentence of the District Court in Wroclaw (case No. I C 144/10) concerning alleged infringement of personal rights.

The result? The Court of Appeal changed the sentence of the District Court and overruled the suit. This means a complete victory! The details of the dispute can be found on our blog: http://blog.e-prawnik.pl.

As for the oral reasons of the sentence, the Court of Appeal stated that the District Court failed to correctly asses the facts of the case and there is no factual or legal basis to charge the defendant for any action that would constitute an infringement of personal rights of the plaintiff. 

The sentence and its reasons are of great importance for NK.pl. The District Court in its sentence has already confirmed the system in which the Client conducts its activity is compliant with provisions of law. The Court has also confirmed that there is no requirement to monitor system resources (!).

The oral reasoning, indicates that the Court of Appeal has not questioned the above findings of the court of first instance. We wait for a written reasoning of the verdict.
